An Analysis and Evaluation of Final Offer Arbitration
نویسنده
چکیده
Final offer arbitration (FOA) and conventional arbitration (ARE) are compared as mechanisms for settling labor disputes. It is recognized that the parties can manipulate their final offers under FOA in order to achieve a more desirable outcome, and the equilibrium pair of final offers is derived as a function of the uncertainty about the arbitrator's award and the relative risk preferences of the parties. Contract zones are derived for both FOA and ARB, and it is shown that the FOA induced contract zone is not unambiguously larger than that induced by ARB. This is contrary to the claims made by supporters of FOA. The quality of negotiated and arbitrated settlements are compared for the two procedures, and it found that both types of settlements are likely to be of lower quality under FOA than under ARB. It is concluded that FOA is not superior to ARB as a dispute settlement procedure because it promotes neither more negotiation nor higher quality settlements.

A Comparison of Arbitration Procedures for Risk-Averse Disputants
We propose an arbitration model framework that generalizes many previous quantitative models of final offer arbitration, conventional arbitration, and some proposed alternatives to them. Our model allows the two disputants to be risk averse and assumes that the issue(s) in dispute can be summarized by a single quantifiable value. We compare the performance of the different arbitration procedure...
متن کاملA Comparison of Conventional, Final-Offer, and "Combined" Arbitration For Dispute Resolution
This paper presents results from a controlled laboratory study of bargaining behavior and dispute rates under three types of arbitration procedures. Two of these-conventional and final-offer arbitration-are commonly used in practice, while an innovative procedure called "Combined Arbitration" (Brams and Merrill 1986) is not currently used. Combined Arbitration combines the rules of the two most...
متن کاملAmended Final-Offer Arbitration is Improved Arbitration: Evidence from the Laboratory*
Arbitration is frequently utilized to settle disputes. Much research has focused on the properties of final-offer arbitration (FOA) relative to conventional arbitration. Both mechanisms should encourage settlement in standard environments, but previous empirical work finds that impasses remain common. A modification of FOA, amended final-offer arbitration (AFOA), has been proposed as an alterna...
متن کاملArbitration using the closest offer principle of arbitrator behavior
In this paper we introduce a model of arbitration decision making which generalizes several previous models of both conventional arbitration and final offer arbitration. We derive the equilibrium offers that risk neutral disputants would propose, and show how these offers would vary under different arbitration procedures. In particular, we show that optimal offers made under conventional arbitr...

Evaluation of architectural designs Judges the design. In this way, it measures the amount of variables in the design from the desired aspect and then judges it. Due to the important role of arbitration in the courses of architectural projects, if the type of arbitration is not clear, it will affect the appropriate atmosphere on arbitration, will cause unrelated demands related to educational g...
